Top Two Candidates Open Primary Act
On June 8, 2010, California voters approved Proposition 14, creating a Top Two Candidates Open Primary. This new method to determine finalists for the General Election will take effect in San Mateo County with the Presidential Primary on June 5, 2012. Voters used to only be able to vote for candidates with the same political party affiliation as themselves. In recent years, decline to state (non-partisan) voters were given the option to vote for partisan candidates when a party allows for such participation. The Top Two Candidates Open Primary system permits all voters to vote for any candidate, no matter the voter's or candidate's political party preference except for the offices of President and County Central Committees.
The Top Two Candidate Open Primary system will make a difference for registered voters in the primary election for state constitutional, U.S. Congressional, and state legislative offices. All candidates for a given state or congressional office will be listed on a single Primary Election ballot. Voters will then be able to vote for any candidate on that ballot, no matter the voter's political party preference. Only the top two candidates from this single Primary Election ballot will advance to the General Election in November, 2012.

NOTE: The 10-calendar-day review period for the impartial analyses below begins at 5:00 p.m. on March 29, 2012, and ends at 5:00 p.m. on April 8, 2012. (This does not change the review period for Rebuttal Arguments, which is as listed in the Election Calendar linked above.)
